Copyright Of Images
Under the copyright and patents act of 1988, Tracey Kelsey, operating as Eye For Life, retains the copyright of all images taken. It is a criminal offence to copy, screen grab, scan or reproduce photographs without written consent by Tracey Kelsey. Once you have purchased digital files you are granted a licence to use your images for personal use. Your purchased files can then be used for sharing with your friends and family on social media sites, and printing out for yourself, family and friends. These images are not to be sold or given to any third parties without prior consent.
Images that are purchased as digital files are not to be altered in any way that change the integrity of the image without prior consent.
Images taken in photographic sessions may be used by Tracey Kelsey/Eye For Life for display or marketing purposes. This could include social media, marketing literature, or galleries on this website.
The use of video recording and your own camera is forbidden during your photographic session.
Booking and Payment
A booking fee is payable when you book your session and this secures your date and time. This fee is non-refundable but fully transferable to another date in the event of illness or if relevant, inclement weather.
Your booking fee will be deducted from the cost of your photographic session, the balance of which is payable by the day of your session.
Payment for orders of digital files, prints and artwork is due in full at the time of ordering.
Liability
If Tracey Kelsey/Eye For Life becomes injured, too ill to work or an emergency occurs, your appointment may need to be cancelled and re-scheduled to a new date. Every effort to re-book your appointment to a convenient time for you. If a new appointment date can’t be agreed the client agrees and accepts the responsibility and liabilities of Tracey Kelsey/Eye For Life is limited to the returning of any fees or deposits paid towards your booking or session fee. Tracey Kelsey/Eye For Life is not responsible for any consequential loss, damages, charges, expenses, accommodation or travel costs.
In the unlikely event of equipment failure, damage or theft that leads to the loss of images captured in your portrait session, liability is limited to the refund of any fees paid by you in relation to the session fee of Tracey Kelsey/Eye For Life.
By booking a photographic session with Eye For Life you are agreeing to all the above terms and conditions.
